Do you want to come to Canada as a digital nomad?

Canada is actively positioning itself as a welcoming destination for digital nomads through its recent Tech Talent Strategy. The strategy aims to attract remote workers who can perform their jobs from anywhere in the world. As of now, digital nomads only need visitor status to relocate to Canada for up to six months while working remotely for a foreign employer.


The Immigration, Refugees and Citizenship Canada (IRCC) has expressed its intent to collaborate with public and private partners in the coming months to explore additional policies for attracting digital nomads. There is an expectation that some digital nomads initially entering Canada for remote work may eventually seek job opportunities with Canadian employers. In such cases, they can apply for a temporary work permit or Canadian permanent residence if offered a job by a Canadian company.


Application Process: For digital nomads or remote workers, the application process involves obtaining a Temporary Resident Visa (TRV) if they are not from a visa-exempt country. The TRV application should demonstrate to the deciding officer that the remote work does not fall under the Immigration and Refugee Protection Regulation's definition of work, which involves activities for which wages are paid or in direct competition with Canadian citizens or permanent residents.


Key Points:

  1. Temporary Resident Visa (TRV): Apply for TRV if not from a visa-exempt country. Demonstrate that remote work does not compete with Canadian labor.

  2. Electronic Travel Authorization (ETA): If from a visa-exempt country, apply for ETA, disclosing the intention to work remotely for an employer.

  3. Border Entry Decision: The Canada Border Services Agency (CBSA) makes entry decisions at the border, having the discretion to determine the length of stay.

Digital nomads approved by CBSA can work remotely in Canada without needing a Canadian work permit. While the Canadian government hasn't released extensive details on the application process, the emphasis is on demonstrating that remote work does not negatively impact Canadian job opportunities.
